Acceptance of Terms
By accessing or using the US Mortgage Resolution LLC (“USMR,” “we,” “us,” or “our”) website and borrower portal at usmresolution.com (the “Portal”), you agree to be bound by these Terms of Use. If you do not agree, do not use the Portal.
Description of Services
The Portal is an online platform for borrowers with non-performing residential mortgage loans to locate their loan, verify their identity, and work toward resolution options. Resolution options may include loan modifications, repayment plans, forbearance agreements, short sales, deeds in lieu of foreclosure, or negotiated settlements. The specific options available depend on your individual circumstances and are subject to USMR’s review and approval.
Account Creation & Security
To use the Portal, you must complete our identity verification process and create an account. You agree that:
- Only one account may be created per borrower
- You must be the actual borrower on the mortgage loan or a legally authorized representative
- You are responsible for maintaining the security of your account credentials, including passkeys and authentication codes
- You will notify us immediately if you suspect unauthorized access to your account
- You are responsible for all activity that occurs under your account
Debt Collection Notice
This is a communication from a debt collector. This is an attempt to collect a debt and any information obtained will be used for that purpose.
Under the Fair Debt Collection Practices Act (FDCPA), you have certain rights, including:
- The right to dispute the debt within 30 days of receiving an initial communication
- The right to request validation of the debt
- The right to request the name and address of the original creditor, if different from the current creditor
- The right to cease further communications upon written request
If your debt has been discharged in bankruptcy, you are currently under bankruptcy protection, or the statute of limitations for personal liability has expired, any communication through this Portal is for informational purposes only. We retain a security interest in the property and will only exercise our rights against the property.
Permitted Use
You may use the Portal solely for personal, non-commercial purposes to manage your mortgage account and work toward resolution. You agree not to:
- Access or attempt to access another borrower’s account or loan information
- Use automated tools, bots, scrapers, or scripts to access the Portal
- Interfere with or disrupt the operation of the Portal or its underlying infrastructure
- Attempt to circumvent security measures, authentication, or access controls
Accuracy of Information
You agree to provide truthful and accurate information when using the Portal. Providing false identity information or attempting to access another person’s account constitutes fraud and may be subject to criminal prosecution under federal and state law.
Communications Consent
By creating an account on the Portal, you consent to receive electronic communications from us regarding your loan, case status, required actions, and resolution options. These communications may be sent via email, secure message within the Portal, or SMS (if you have provided a mobile number and opted in). You may update your communication preferences within your account settings.
Limitation of Liability
The Portal is provided on an “as-is” and “as-available” basis for your convenience. USMR makes no warranties, express or implied, regarding the Portal’s availability, accuracy, or fitness for a particular purpose.
The information presented through the Portal is not a substitute for professional legal, financial, or tax advice. You should consult with qualified professionals before making decisions about your mortgage. USMR is not liable for any decisions you make based on information provided through the Portal.
To the fullest extent permitted by law, USMR shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Portal.
Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law principles.
Dispute Resolution
Any dispute arising out of or relating to these Terms of Use or your use of the Portal shall first be addressed through good-faith negotiation between you and USMR. If the dispute cannot be resolved through negotiation within 30 days, it shall be submitted to binding arbitration administered in Wayne, Pennsylvania, in accordance with the rules of the American Arbitration Association. The arbitrator’s decision shall be final and binding.
Modifications to Terms
We reserve the right to modify these Terms of Use at any time. When we make material changes, we will update the “Last updated” date at the top of this page and, where appropriate, notify you through the Portal. Your continued use of the Portal after modifications are posted constitutes acceptance of the updated terms.
Severability
If any provision of these Terms of Use is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
